What is a fiduciary
relationship?
A fiduciary relationship is a
special relationship which imposes duties of fidelity,
undivided loyalty, full disclosure, utmost care and
good faith.

California Civil Code defines this duty as
one of utmost care, integrity, honesty and loyalty.
The Code of Ethics of the National Association
of REALTORS® (NAR) defines the duty as the obligation
of absolute fidelity to the client’s interest.
In the case where
Joanne represents both the buyer and seller, known as a
dual-agency relationship, she cannot without the
principal’s consent, disclose to a seller that a
buyer is willing to pay more than the offered price nor
may a dual agent disclose to a buyer that the seller is
willing to accept less than the listed price (Civil Code
2079.21).
